General Terms and Conditions (GTC)

A) Scope

  1. These terms apply to contracts for the rental of hotel rooms for accommodation and all other services and deliveries provided to the customer by the hotel.
  2. The subletting or re-letting of the provided rooms and their use for purposes other than accommodation require the hotel’s prior written consent.
  3. Customer terms only apply if agreed upon in writing in advance.

B) Contract Conclusion, Parties, Statute of Limitations

  1. The contract is concluded when the hotel accepts the customer’s offer. The hotel may confirm room bookings in writing.
  2. The hotel and the customer are contractual partners. If a third party makes the booking for the customer, they are liable alongside the customer.
  3. All claims against the hotel expire after one year from the start of the statutory limitation period. Damage claims expire after five years. These reductions do not apply to claims based on intentional or grossly negligent breaches by the hotel.
  4. The hotel may require a reasonable advance payment or security deposit from the customer.

C) Services, Prices, Payment, Set-Off

  1. The hotel is obligated to keep the rooms reserved by the customer and to provide the agreed services.
  2. The customer is obligated to pay the applicable or agreed hotel prices for room provision and other services used. This also applies to services and expenses incurred by the hotel from third parties at the customer’s request.
  3. Agreed prices include applicable taxes and local charges at the time of contract conclusion. Excluded are local charges payable by the guest under municipal law, such as bed taxes.
  4. If the period between contract conclusion and fulfillment exceeds four months and the hotel’s general prices increase, the hotel may adjust the contract price appropriately.
  5. The hotel’s invoices without a due date are payable within ten days of receipt without deduction. The hotel is entitled to demand immediate payment for due invoices at any time. In case of default, the hotel may charge interest at 8 percentage points above the base rate or 5 percentage points for transactions involving a consumer.
  6. The customer can only offset or reduce an undisputed or legally binding claim against a claim of the hotel.

D) Customer Withdrawal

  1. The customer’s withdrawal from the contract requires the hotel’s written consent. If not provided, the agreed price must be paid even if the customer does not use the services.
  2. If a withdrawal deadline is agreed in writing, the customer can withdraw from the contract without incurring charges or compensation claims until that date. If the customer fails to withdraw by the agreed deadline, the right to withdraw expires.
  3. If the customer does not use reserved rooms, the hotel must credit the income from other rentals and the saved expenses.
  4. The hotel may charge the customer a lump sum compensation. The customer must pay at least 80% of the agreed price for overnight stays with or without breakfast. The customer may prove that the claimed compensation did not arise or is lower.
  5. Early departure or late arrival does not entitle to price reduction.

E) Hotel Withdrawal

  1. If a free withdrawal period is agreed in writing for the customer, the hotel can withdraw from the contract within this period if there are inquiries from other customers for the booked rooms and the customer does not waive their right to withdraw.
  2. If an agreed advance payment or security deposit is not made after a reasonable grace period set by the hotel, the hotel may also withdraw from the contract.
  3. The hotel may withdraw from the contract for justified reasons, such as force majeure, misleading information about the booking, or if the stay endangers the hotel’s operations, security, or reputation.
  4. In the event of a justified withdrawal by the hotel, the customer has no right to compensation.

F) Room Provision, Handover, and Return

  1. The customer has no right to specific rooms unless agreed in writing.
  2. Reserved rooms are available from 3:00 PM on the arrival day. There is no right to earlier availability.
  3. Rooms must be vacated by 11:00 AM on the departure day. The hotel may charge 50% of the full room rate for late vacating until 6:00 PM and 100% thereafter.

G) Hotel Liability

  1. The hotel is liable for its contractual obligations. Claims for damages by the customer are excluded except for injury to life, body, or health due to the hotel’s breach of duty, or other damages based on intentional or grossly negligent breaches by the hotel.
  2. The hotel is liable for items brought in by the customer under statutory provisions, limited to 100 times the room rate, up to a maximum of 3,500 EUR, and 800 EUR for money, securities, and valuables.
  3. The provision of a parking space does not constitute a safekeeping agreement. The hotel is not liable for loss or damage to vehicles and their contents.
  4. Wake-up calls are performed with care, but damage claims are excluded unless caused by gross negligence or intent.
  5. Messages, mail, and goods for guests are handled with care. The hotel manages delivery, storage, and forwarding upon request.

H) Improper Conduct by Guests

  1. The hotel is a non-smoking establishment. Smoking is prohibited throughout the hotel, including rooms.
  2. Unauthorized interviews, sales, and similar events may be stopped by the hotel.
  3. Dogs are allowed with prior consultation for a fee but are not permitted in the breakfast room.

J) Final Provisions

  1. Amendments and supplements to the contract or these terms should be made in writing.
  2. The place of performance and payment is the hotel’s location.
  3. The exclusive place of jurisdiction for commercial transactions is the hotel’s location.
  4. German law applies. The application of the UN Sales Convention and conflict of laws is excluded.
  5. If individual provisions of these terms are invalid, the validity of the remaining provisions is not affected.
  6. Compensation claims are not considered if unavoidable circumstances beyond the landlord’s control are present.
